Terms of Use — Crownwise

Please read these terms before using Crownwise (the “App”). By using the App you agree to them. If you do not agree, do not use the App.

1. What Crownwise is

Crownwise is a calculation and documentation tool for qualified tree risk assessors. It records the observations and judgements you enter, applies the published tree risk assessment matrices to the inputs you choose, and assembles the result into a report document.

2. What Crownwise is not

Crownwise does not perform tree risk assessment and does not give arboricultural, engineering, legal or safety advice.

• Every assessment input — likelihood of failure, likelihood of impacting the target, and consequences of failure — is selected by you.
• The App applies a published matrix to those inputs. It does not observe trees, it does not judge them, and it does not form an opinion.
• The professional opinion in any report produced by the App is yours, and you are solely responsible for it.

The App is a tool in the same sense that a calculator or a word processor is a tool. It does not replace the training, qualifications, site inspection or professional judgement of a competent assessor.

3. Your responsibilities

You are responsible for:

• holding and maintaining the qualifications and insurance appropriate to the work you carry out;
• the accuracy of everything you enter, including observations, measurements, descriptions and photographs;
• reviewing every report in full before you sign, send or rely on it;
• deciding whether the App’s output is appropriate for the assignment, and amending or discarding it where it is not;
• complying with any standards, regulations or professional obligations that apply to you.

4. Ownership of your work

Your assessments, photographs and reports are yours. They are stored on your device. We claim no ownership of them and no licence over them.

5. Availability and data

The App works offline and stores your work locally on your device. We do not operate a server that holds your assessments, and we cannot recover your data if your device is lost, damaged, reset, or if the App is deleted.

Keep your own backups. Device backup (for example iCloud device backup) and exporting finished reports are the practical means of doing so.

6. Subscription

The first three reports are free.Generating further reports requires an active subscription, sold through the Apple App Store and billed to your Apple ID. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple ID settings. Refunds are handled by Apple under its own policies.

7. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that any output will be suitable for any particular purpose or accepted by any third party.

8. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any loss or damage arising out of or connected with the use of the App, including but not limited to property damage, personal injury, death, professional liability, claims by third parties, loss of data, loss of profit, or loss of business, whether arising in contract, tort (including negligence) or otherwise.
• Because the professional opinion recorded in any report is yours, and because the App does not observe, judge or advise, responsibility for that opinion and its consequences rests with you.
• Where liability cannot lawfully be excluded, our total aggregate liability is limited to the amount you paid for the App in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud.

9. Third-party names

Any professional qualification, certification or standard referred to in the App is named only to describe the credential held by you, the assessor, or the methodology applied. Crownwise is an independent product. It is not affiliated with, endorsed by, sponsored by or certified by any professional body, standards organisation or certifying authority.

10. Changes

We may update these terms. Continued use of the App after an update means you accept the revised terms. Material changes will be reflected in the “last updated” date above.
